RIAA (Recording Industry Association of America) issued another 754 subpoenas as part of its "sue 'em all" marketing drive. This makes close to 17,000 Americans who are being hounded by Sony BMG (Japan, Germany) Vivendi Universal (France), EMI (Britain) and Warner Music (US) for downloading music from the p2p file sharing networks. An estimated 51 Mio Americans get their musical fix from downloads; yet the Big Four claim their "sue 'em all" campaign, under which not one of 17,000 victims, who include senior citizens and schoolgirls, has yet been found guilty of anything, is boosting sales and "deterring" people from sharing files with each other. In this effort, RIAA has filed litigations in California, Georgia, Missouri, New York, Virginia, and Washington, DC.
If you have an opinion regarding this matter, any comment to share, please e-mail me at Gina@wildaxes.com; I'd like to get a feel of what people think of this.

About a month ago, it was reported that 38-year-old FASTER PUSSYCAT guitarist Brent Muscat was diagnosed with oral cancer. Brent's wife EJ, posted the following update in the FP forum:

"Brent had surgery on November 8th to remove the cancer. It was 3 1/2 hr surgery, and it went very well. Until I left him at midnight, he was wide awake, and was curious about everything. He constantly wrote down questions about his conditions, and the surgery. He seems happy to hear that the doctors were very satisfied with the surgery. He's doing very good, and everything seems to be going well so far. Please keep on praying for him until he's cancer-free! Thanks millions and millions to EVERY single one of you who's prayed for him (us). We really appreciate that. And we love you all! THANK YOU!!!!"

Love EJ Muscat

In an earlier posting, EJ pointed out that, "Brent is NOT a smoker. He never smoked. It is VERY rare for someone like him who doesn't smoke and/or drink and is under age 40 to have this kind of cancer. Bad Bad Bad luck." All staff members of Wild Axes wish him a speedy recovery!

Legendary UK rock band Led Zeppelin and Russian conductor Valery Gergiev were named winners of the Polar Music Prize. The awards are likened to the Nobel Prize, with winners receiving one million kroner (£70,523) from the Royal Swedish Academy of Music. The academy said Led Zeppelin were "one of the great pioneers of rock". Gergiev was cited "for the way his unique electrifying musical skills have deepened and renewed our relationship with the grand tradition and has managed to develop and amplify the importance of artistic music in these modern changing times". Valery Gergiev is artistic director of the Mariinsky Theatre in St Petersburg. The Polar Prize was founded by Stig Anderson, the former manager of Swedish pop group Abba. Previous winners have included Sir Paul McCartney, violinist Isaac Stern and music producer Quincy Jones. The prize will be awarded by Sweden's King Carl XVI Gustaf at a ceremony on 22 May 2006.

Motörhead frontman, Lemmy has used an anti-drugs platform at the Welsh assembly to call for the legalization of heroin. The singer took time off from the bands 30th anniversary tour to share the fatal dangers of the drug with Conservative AM William Graham. Lemmy think that making heroin legal would allow it to be taxed and regulated and keep users away from drug dealers. Mr Graham said Lemmy presented "alternative" views to his own, but the message was firmly against drugs. Lemmy, who was brought up in Anglesey, said he first became aware of heroin users after he began touring in north Wales in 1967. He met junkies on the music scene and described how one woman he lived with tried the drug "to see what it was like". She died within three years. He explained how his hatred of the drug was so strong he once turned in a dealer to the police. Lemmy said: "It (heroin) turns people into thieves and liars. It removes them from the social circle. All they are thinking about is junk". Lemmy said legalization was the way forward, as heavier policing had failed to beat drugs. "You can't keep people from doing what makes them feel good. The reason they do heroin in the first place is because of the oblivion it gives them". Mr Graham made clear that he believed decriminalization should be considered rather than legalization. He also said there could be "pilot areas" created in which heroin users brought before the courts would be treated rather than punished. This April Prop 36 did exactly that ... lets see if it works.

ThinkFilm secured the worldwide rights to "Awesome: I F ' Shot That," a colorful Beastie Boys concert documentary. The footage for the film is shot primarily fans with Hi8 cameras at Madison Square Garden. Beastie rapper Adam "MCA" Yauch produced the flick. He describes the footage as "Frantic". Jon Doran co-produced the project via their Oscilloscope Films for around a $1 million. The film was submitted to Sundance and is scheduled to release in early spring. "Preproduction was like three days," said Yauch, who was inspired by "Some kid who put up video from his phone at eight frames a second".

Every attorney's dream client, Courtney Love, has been sued by the law firm of Hendricks & Lewis for more than $340,000. The firm claims Love has failed to pay for legal work performed in her name. According to the firm's suit, which was filed this week in Seattle, Hendricks & Lewis alleges it performed services for Kurt Cobain's widow that netted her more than $5 million--including negotiating deals for a coffee-table book on Cobain (Journals) that was released in 2002 and a Nirvana greatest-hits album. Love is heir to her late husband's fortune and controls the rights to his legacy. This is the second time that Love has been sued by a law firm. Los Angeles-based Manatt, Phelps & Phillips sued the "Malibu" singer last year, alleging it, too, was owed cash for legal services rendered. The 41-year-old rocker, who is currently in rehab, and is pocketing millions annually thanks to publishing royalties from Nirvana's lucrative back catalog, Love was sued in August by Mercury Capital Corporation, which claims she hasn't made a mortgage payment on her New York loft apartment since June. Love blamed former Nirvana drummer Dave Grohl--a onetime legal sparring partner--for her financial woes by telling Spin magazine that the current Foo Fighter has been "taking money from my child for years."

Robert Plant has vowed never to reform supergroup LED ZEPPELIN for a stadium tour. He says he'd rather sing their classic hits with his new band STRANGE SENSATION at tiny venues to just 1500 fans. Plant, 57, who plays Edinburgh Corn Exchange next Thursday and Barrowland in Glasgow on October 29, said: "I've not been offered vast sums to reform Led Zeppelin. I would never do it anyway. We were a boy band and I'm not a boy any more. I prefer my career to have a bit of dignity now.

Kicking off in January, his housemates will include Tawny Kitaen (WHITESNAKE mainman DAVID COVERDALE's ex-wife), Sherman Helmsley (aka George Jefferson of The Jeffersons, Playboy TV's Andrea Lowell and actress Alexis Arquette.

P.O.D.'s new record - Testify - is almost finished and is scheduled for release in early Spring. The guys just finished shooting their latest Video "Goodbye for now" in the greater Los Angeles area, complete with 100 fans who got the chance to participate through the P.O.D. fan club. The band is promoting their EP during the month of December, but expect a massive U.S. headline U.S. once "Testify" is released.

As if the playing of some guitar heroes wasn't enough, I came about a rather fascinating event in Germany called "Jukuz", an annual Air guitar Competition. The first "Wettbewerb" was held a baffling 21 years ago and has been a tradition ever since. I also found Guitar Hero (published by RedOctane, the makers of Karaoke Revolution), the latest video game in which a plastic guitar peripheral is used to crunch power chords and nail tough solos. The guitar features five buttons on the fret board and a plastic button that can be tapped up or down where the strings would be strummed. Playing the songs here is simply a matter of holding down the right fret buttons and tapping the strum button in time with the music. This is all done along with the commands that scroll down the screen in an interface that's very similar to that seen in Frequency or Amplitude. Game play is simple: there are five lines on the screen for the five different buttons. Markers scroll down the lines and as they hit the bottom of the screen the corresponding "notes" need to be hit. The game features multiple skill levels and about 30 songs. Maybe we can start a whole new competition ....

Sony-BMG announced a recall of music CDs that contain copy-protection software that behaves like a virus and creates security concerns for users when the discs are played on a computer. The recall affects some 2.1 million CDs. The XCP copy-protection software, developed by British software firm First4Internet, was intended to prevent computer users from making digital copies of a CD, but instead it allows any Web page visited to download, install, and run any code it likes on your computer. "Sony-BMG should treat its customers with respect and fairness; instead it acted little better than the thugs who unleash stealth computer viruses on the public," EFF Staff Attorney Corynne McSherry said in a press release. "Halting production is not enough. Sony needs to take steps to fix that damage it has already caused and ensure that nothing like this happens again in the future."" Any Web page can seize control of your computer; then it can do anything it likes. That's about as serious as a security flaw can get."The software is only known to affect computers running Microsoft Windows. Check the Sony website for a listing of affected albums and other updated regarding this problem http://cp.sonybmg.com/

Grokster is the latest of the formerly independent file sharing companies to agree to "stop distributing software that allows users to copy songs without permission as part of a settlement with the recording industry", as per the RIAA (Recording Industry Association of America). LimeWire was the first to capitulate when RIAA began sending Cease and Desist or Else letters to commercial file sharing firms. Its software now includes Digital Restrictions Management code. However, a group of LimeWire aficianados are keeping the LW flag flying with their indie FrostWire application. eDonkey, which had taken over from Kazaa as King of the commercial p2p apps, also decided discretion was the better part of valour and as a direct result of the cartel Cease & Desist letter, its owners decided to comply with OM demands. Of the three remaining commercial p2p companies, BearShare is still online, as is Warez P2P, and far from caving in, Morpheus owner StreamCast has just released Morpheus 5.1. Improvements include audio and video exporting to iPod through iTunes, one-click CD burning, and firewall-to-firewall transfers, increasing the number of available files users can more easily download, says the company. "The deal is the first of its kind between a distributor of major independent recording artists and wildly popular file-sharing software, and is part of Morpheus’ Peer Response, an initiative to work with labels and artists in delivering greater value for consumers while compensating copyright holders," says StreamCast ceo Mike Weiss.iMesh, another ex-indie company, has become a full blown corporate music site, and Wayne Rosso who, at different times, ran Grokster and Blubster, now chairs Mashboxx, an industry application built around Snocap, 'verification' software marketed by Shaw Fanning, the man who got the p2p file share ball rolling with Napster.
Your head hurting now ...?

Black Sabbath are finally to be inducted into the UK Music Hall Of Fame. Sabbath, who enjoyed great success with a string of hits including the anthemic "Mama, I'm Coming Home", were famed for their legendary stage shows. A clearly delighted Ozzy commented: "For once in my life I'm speechless, but very happy and honoured." Osbourne will be honoured alongside Bob Dylan, Pink Floyd, Jimi Hendrix, New Order, The Who and The Kinks. The late John Peel will become an honorary member. The ceremony will take place at London's Alexandra Palace on November 16.

The futuristic musical "We will rock you", which went straight from London to making its debut in Las Vegas, is now scheduled to close at the end of November. The show, written by Ben Elton, featuring more than 20 hits by QUEEN will commence after 520 performances. The show is scheduled to continue in Europe in 2006. "We Will Rock You" is based on an alternate reality where an evil queen who despises rock music will vanish anyone who listens to it. Her trusted aide who is supposed to fulfill the task harbors a secret love for the music, besides that he is insane with ambitions of his own.

Adema are once again without a vocalist. Luke Caraccioli, who replaced Marky Chavez, announced his departure from the band in the statement below:

"I know that there are a lot of rumors floating around the internet, and I want to make sure that you guys the dedicated fans here the truth straight from me. I want to first and foremost dispel any rumors that I hate Kris or ANY member in Adema, I do not nor will I ever hate them, and the person that is spreading that kind of garbage is an attention hungry person that likes to spread around drama. Now, It is with an extremely heavy heart that I say that just a few hours ago I made the decision to leave Adema. This decision is going to be a shock to you all I am sure, and I am deeply sorry that I could not stay in the band. I do not wish to get into the details or reasoning for this decision other than to say that it is for my own personal reasons and a decision that I HAD to make at this point in my life. I hope that you all will stay on board with the guys from Adema, they are mega talented musicians, and I am sure that they will have something going on in the near future. I have greatly enjoyed getting to know all of you, and talking to you guys on line, you are all the greatest fans in the world and without you it would have meant nothing to be in a band at all. You guys have been VERY accepting and caring towards me and for that I am forever thankful as well, I look forward to continuing to talk to you anytime you want. I am not sure of what my future holds, but I have been jamming with the guys from my old band Rewind Yesterday in my off time from touring with Adema, AGAIN this has NOTHING to do with me leaving, it was until now a side project with my close friends. IF you wish to keep up with what is going on with me, I invite you all to check out http://www.myspace.com/

Ricky Wilson has collapsed yet again during a gig. Kaiser Chief was performing in Birmingham, GB on Sunday night when Wilson, who has already collapsed several times this year, performed so hard that he collapsed after the show. One witness on the bands official forum said that drummer Nick Hodgson "poured a bottle of water over his head and he still didn't get up." Another reports that: "Ricky ran off stage and suddenly keeled over". The bands new single 'Modern Way' is scheduled for release on November 7.

While the future of Weezer is in question, frontman Rivers Cuomo knows exactly what he'll be doing in 2006. As expected, Cuomo will be returning to Harvard University in February to finally finish his degree in English Literature, which he started back in the mid-'90s. Cuomo was at Harvard when he wrote much of the fan-favorite album Pinkerton. Until then, the band is still on the road with the Foo Fighters, promoting their latest album, Make Believe. They recently shot a video for the third single, "Perfect Situation," only without Cuomo as the singer. Director Marc Webb described the concept to MTV.com, saying, "We are exploring the history of Weezer. It's the Weezer prequel, if you will, and we're going to document the early days of the band. A lot of people don't know this, but before Weezer was Weezer, they were a band called Weeze. Rivers was just a roadie for the band, and they had a totally hot female singer." Well what do you know...

THE MERCY CLINIC has just booked it's next show Friday, December 16th in Hollywood, CA at the Viper Room. The Band go on at 7:45pm sharp. The Los Angles based band consists of Patrick Lachman (Vocals, who played guitar with Judas Priest frontman Rob Halford), Brian Harrah (Guitars), Josh Stinson (Guitars, who played the local scene with DRIST and Steed Najera, formerly of TRIPLE SEVEN), Steed Najera (Bass), Bevan Davies (drums, who played with DANZIG and Jerry Cantrell). Once the creative process began to build, the five quickly jelled as a songwriting unit. According to Lachman, "Once we finally all got in a room to write together, there was an immediate chemistry and the songs just kept on coming. We were really comfortable, and very open about the whole process. There were no rules, no egos, just a common goal to write songs that WE could listen to over and over." As the members developed a bond as friends and artists, the name of the band itself was conceived as a musical metaphor. They used songwriting as an outlet to vent, in a time where they feel that music has become somewhat superficial and meaningless. Lachman explains, "The concept reflects the content, which is largely a purging of our negativity. It has an intentionally dark overtone." The results speak for themselves, heavy rock songs which push the boundaries of hard rock music, rather than trying to fit into any one specific niche or genre.

The Darkness singer Justin Hawkins paid £350 for a copy of his own band's new album on eBay before its release on November 28th to stop it being leaked. The CD was sent to a small number of record company figures and journalists around the world but found its way onto the auction site in Australia. "It's encoded so we'll have a name and a number - we'll know which disc it is, who distributed it and who they distributed it to. And that person is going to go down" commented Hawkins, "He/She is either going to get some sort of legal intervention, but certainly won't receive an album from our record company ever again." Hawkins said the band had been stringent with who they had given the album to in the UK. An eBay spokesperson said their rules did not "specifically prohibit" the resale of advance CDs.

That cast of colorful characters, which originally came together in 1977, reunited in 1998 and has been sporadically touring ever since. X's last release was "Live in Los Angeles," a document of a pair of 2004 concerts that was released on both CD and DVD formats.

Outspoken rocker Ted Nugent is defending controversial comments he made about reality TV family "The Osbournes," insisting Sharon Osbourne should be held accountable for celebrating domestic chaos. He touched a nerve when he slammed The Osbournes for presenting the worst of family life on TV. But, despite criticism and comeback from Osbourne herself, Nugent is refusing to back down. "I was condemning the celebration of chaos, the celebration of anti-parenting. I think it's absolutely an indictment to the soullessness of our society when we can find humour or something entertaining about a family that has no discipline, that celebrates crime and smoking dope and getting drunk. I think it's absolutely putrid." And he repeats his belief that Osbourne is a terrible mum and wife: "I don't think she's on top of squat except the bank account for her husband, that she takes advantage of. I think she oughta be slapped silly... She should be put in her place." ... that should go over well ...
